Man’s 7th OUI conviction restored

With decision, SJC declines to issue ‘Superman’ rule of law

The Supreme Judicial Court yesterday reinstated a man’s seventh drunk driving conviction, ruling that an off-duty Somerville police officer simply acted like a cautious citizen when he seized the man’s keys and ordered him to wait in his car until a Woburn police officer arrived. The ruling by the state’s highest court means Joseph Limone now has seven drunk driving convictions on his record, and that police do not have to change into civilian clothes every time they leave work or a paid detail.
