Tribe retains casino advantage

Ruling is setback for developer

Advantages in state law for a Native American tribe pursuing a casino are constitutional and will be allowed to stand, a federal judge decided, as he dismissed a challenge to the law by a developer seeking to build a casino in New Bedford. The developer filed its lawsuit hours after Governor Deval Patrick signed the casino legislation into law. The suit challenged a provision that delays open bidding on a commercial license in southeastern Massachusetts until at least August.
