Kraft Group sued over deaths after tailgating

DEDHAM — An attorney for the Kraft Group, which owns Gillette Stadium and the New England Patriots, argued in court Tuesday that a deadly car crash following a 2008 concert at the stadium is not the company’s fault and that the ­deceased driver and passenger and ­another friend who survived had trespassed and illegally brought alcohol to the tailgating festivities.

“They brought their own supply of alcohol,” said Douglas Fox, attorney for the Kraft Group, during a hearing in Norfolk County Superior Court to determine whether the lawsuit should go to trial. “. . . They had no right to be where they were.”

It is amazing how people have the gumption to sue someone in a “get-rich-scam.”

Very sad story but what happened to personal responsibility? It's always someone else's fault now. I was at that show. The parking lot was a disaster but they shouldn't have been there without tickets and they certainly shouldn't have been drinking.

An unmitigated tragedy to be sure. My heart goes out to the families, including of the survivors, who will never be the same. That said, let me get this straight. A group of underaged, but adult (voting age) people illegally obtain alcohol and go to an event for which they do not have tickets and have no intention of buying tickets or attending the event. They drink to excess with no plan to secure their safety by designating a driver, then leave and crash their car. And we are supposed to think that the owner of the parking lot where they did (some of) their drinking is at fault. Do I have that right?

I had sympathy for the families BEFORE the lawsuit, now I only have scorn. O K, you got your name in the paper...and you are attempting to benefit from your offspring's...now please go away.

A tragedy for the families....but - these women made a choice to drink to excess and then drive. The responsibility lies solely with them. We can't keep holding 'others' responsible for our own bad choices, especially when those choices result in predictable outcomes.

I want to thank all the people for their comments on "taking personal responsibiltiy for our actions as well as the actions of our families".   We see far to often people not doing that, and it is great to find that I am not at all alone in my thinking.

I remember this accident very well.  It became a teaching event in my house and we still see the memorials when we drive by that area.  Sad and unfortunate to be sure but apparently the inability to take resposibility was a trait handed down from Mrs. Davis to her daughter.  Sadly a so called "lawyer" with a penchant for chasing dollars at the obvious expense of his client has enabled the Davis family to continue to believe they are right.  I'd suggest that Mrs. Davis make two calls.  First, fire your lawyer.  Second, you and the Houlihan family should call the Latteo family and apologize for dragging them into a case by inference when they clearly had the common sense to take the right path.

Mr. Borsellino should be ashamed of himself. 

I am with all the other posters on this.  Somehow the Krafts are at fault for girls who die or are injured after willingly consuming too much alcohol and then getting in a motor vehicle?  Incredible reasoning, but typical in this day and age where there is little personal responsibility and too many lawyers who will take a case just to get their name in the paper. What happened to ethics and integrity?

Of course, most lawyers know that insurance companies would rather negotiate/settle than go to trial and face jurors who will say things like "the Krafts have lots of money, they can afford it," rather than doing the right thing.  So, the families get some money, the lawyer gets a lot of money and free publicity, and there is no justice.  

This is what our society has come to.  Sad, very sad.

I pray that this judge does the right thing.

This is BS, They didnt have tickets to the show and were not on the property but The Krafts are responsible ? So if I am drunk and crash into a light pole and there is a Stop and Shop nearby its there fault???

I agree with everyone else.  You do somethng stupid, dangerous, and illegal, and you get hurt, it's your fault. You take your life in your hands everytime you walk in the crosswalk and don't pay attention to cars, thinking you have the right of way, every time you ride our bike and aren't defensive about cars. People need to lean how to assess and take risks and to learn they are responsible for what happens.

There is always a blame pie but the majority of the slices belong to the young women who drank and drove or drank and chose to get in the car with a drunk driver. There should be no lawsuit here.
