Another free pass for Ivan the incorrigible

Despite more than 100 criminal charges, Ivan Vaclavik has dodged deportation for nearly four decades. He contends he can’t be sent home because his homeland no longer exists.

As Ivan Vaclavik tells it, he is a man without a country, an ­emigre from the former communist-ruled Czechoslovakia who can never be deported no matter how badly he behaves in his ­adopted United States. His homeland, he points out, no longer exists, washed away in the collapse of the Soviet Union.

Vaclavik has certainly put his theory to the test. Since 1976, when the United States first ordered him deported, he has been charged with more than 100 crimes in Massachusetts, from petty shoplifting to felony theft, and has been imprisoned at least three times. Highlights of his criminal career include assaulting a complete stranger at a Starbucks on Beacon Hill in 2005, breaking into the Charles Hotel in 2007, and accosting an 11-year-old girl near a hotel pool in Waltham in 2009. “Come in here and see your daddy,” he told the frightened child.

 "Give me your tired, your poor, Your huddled masses yearning to breathe free".  Yeah, right.  How many "strikes" will this person be allowed before he is sent to prison for the rest of his useless life?  How can we have immigration reform when ICE can't even handle what they have now?

If he's a bad guy and a real, dangerous criminal type, then the justice system surely would not have much problem putting him away. Just take at look at the Aaron Swarz case where the charges would have amounted to 35 years in jail for stealing documents. If he's mostly nasty but not criminal then, hey, it's not illegal to be nasty. I know that many would LIKE it to be illegal. After all, that's one of the things living in a highly controlled, parochial "village" would seem to guarantee. Guess the back channel stiffing just isn't working on this guy? I tell you what, he looks like my idea of a Nazi prison guard, or a Soviet apparatchik, not just his black leather (macho), black fleece (practical and warm and doesn't show the dirt) and his black t-shirt (cheap and a good combination fashion statment), but the expression on his face.  How about this: someone in Hollywood "helps out" and casts him as the bad guy in a movie. Perhaps with lots of money coming in he will realize the cost of being sued and start to behave better (if not, at least he's out of the area).

The other thing I should note is that this guys is not a very cooperative type. The system is designed to vastly overcharge for criminal behavior so that the perp is forced to plead guilty and settle for a much lesser sentence. This is the way it's supposed to work in America. That way, justice saves money by not having to take judges and juries time, the perp saves time and money -- in short, everyone saves and its a win-win. Now when someone refuses to settle and actually learns the law and is able to file suits himself (or herself) then that really is despicable. Prosecutors don't know the law very well anymore and aren't good at, well, presecuting (in court, that is) and the whole  thing just falls apart. If this guy wants to know the law and fight things he should do what all other Americans do who feel this "need" -- he should do the right thing (and become a lawyer).

Despite possibly being a sociopath, he seems to have an aptitude for legal studies and good taste in champaign .  Doesn't Deval have a new program for Ivan and other illegals to study at UMass?

Thank you Globe for continue to pursue these stories that have had a real impact on improving the system.  Now, please follow up by securing answers from the appropriate departments as to why non complient countries are allowed to be noncomplient with no retribution?  

It's long past time we got serious about taking care of our own first and foremost.  I can not locate what amount of foreign aid the Czech Republic receives from the US, but we should be withholding all aid to all countries that do not comply with our laws 100% period.

Yes Globe, follow up and get answers from our new Senator and soon-to-be Secretary of State.  Our new Secretary can do much to aleviate this problem.

Well If you can't deport him why can't his crazy self go to prison and stay there???? All im thinking about are the mothers fathers grandparents daughters sons who have been deported (no question asked, no trial, no notice given) simply because their visas expired. Sending his butt to another country (any country) would be a crime in itself because this man has no Morale. No guilt No shame No fear. He is probably at a point where he might feel he can get away with murder now; He would just go on to harm other people.

If he can't be deported and yet he continues to perform varied criminal acts, why can't he be sentenced to life in a maximum security prison?

Uncle Omar, Aunt Zetuni, and the gangster murderer, Portillo (the other day on trial)  that shot someone in the head  in common all illegal and were to be deported many times and still here....so much for our immigration policies and what will make you even madder is they are illigble for benefits...Aunt Zetuni lives on welfare  all her life here, never put a days work in.....and Uncle Omar will collect social security because he works even though illegal and this loser will also....welcome to america the benefits are great

Deport him to Gitmo!

While I am usually at odds with the Globe's editorial positions, it is investigative journalism as this that makes the Globe and such newspapers important to society.  As the great "muckraking" newspapers of old continue to fail and fold and with them expose/invetigative articles, our government will get away with more and more.  No oversight, no worries.

This is the second time in recent months where this problem has been brought to our attention, yet nothing changes.  Why?  No one cares.  Why?  Because we still re-elect the same people to represent our interests and they obviously do not care.  It is disgusting?

I want to know what our new Senator Warren intends to do about this?  I want to know what are soon to be ex-senator and soon to be Secretary of State intends to do about this?  Mr. Secretary will you and your boss, the President take a stance against countries who refuses to take back their problem citizens?  What will the rest of our Congressional delagation do?

Here is a guy who obviously has to break the law to have money to survive in our country and no one will do anything about it.  Amazing, simply amazing!

Actually, the politicians do very little of anything that will not benefit them. Markey was in charge of telecommunications for 20+ years and look at the crazy mess we have with television charges and programming. Also the exhorbiant costs of wireless service!!!

The average person must be concerned with encountering dangerous illegal aliens. Also, there are many immigrants with student or visitation visas who fail to honor the end date.

What is needed is a better tracking system of entry into the country. Airport screening of passports of non-citizens and sending illegal aliens to their country of origin on one-way-tickets.

Lets the countries of illegal aliens deal with them.
