The Globe needs to reveal the race of the victim so readers can determine if this was another case of racial profling by the perpetrators.  If the victim is white or asian then the blacks needs to come out and protest this incident of racial profiling.

EXCERPT FROM ARTICLE:

"the quick investigation, O’Leary said investigators used video footage from private properties in Brookline (private properties in Brookline???) to see which direction the robbers fled Tuesday after the holdup at Pleasant and Browne streets. MBTA Transit Police assisted with footage of two men using the stolen credit card at the Jackson Square MBTA Station."

COMMENT: How can the footage at the MBTA station pick up the card number etc.This doesn't make sense but it must to somebody else.

Also, how does knowing which direction they fled help the police to know that they would show up at the Jackson Square MBTA station? Also, there is no information as to whether or not the Browne and Pleasant St. private camera(s) (??) was (were) able to photo their faces if they were masked. (See excerpt below). Is this poor news reporting or cover-up?

Also, they are charged with intent to murder? What kind of a charge is this?  How do you know whether a robber intends to murder or not.? Go figure. This is typical of law enforcement's  habit of overcharging (not just Brookline) for their own unexplainable agendas.

The crime of Armed Assault with Intent to Murder or Kill is the unlawful assault of another, while armed with the intent to cause cause death.  Massachusetts General Laws Chapter 265, Section 18 punishes persons convicted of Armed Assault with Intent to Murder or Kill with commitment to state prison for up to 20 years; and if armed with a firearm, for a term not less than 5 years.

For the crime of Armed Assault with Intent to Murder or Kill the prosecutor must prove:

  1. That the defendant was armed with a dangerous weapon;
  2. That the defendant assaulted a person; and
  3. That he possessed a specific or actual intent to cause the death of the person assaulted.

Whether the defendant possessed a specific or actual intent to cause the death of another means that he had it in his mind to do the act.  Intent involves concentrating or focusing the mind for some period of time to consciously and with determination, to commit an act to cause the death of the person assaulted.  An intent merely to disable or scare off another is not sufficient intent for the crime of Armed Assault with Intent to Murder or Kill, nor is the intent to inflict bodily injury or serious bodily harm.
