Two men were acquitted Monday of attempted murder but convicted of assault in a beating that fractured a Massachusetts man’s skull in the heart of Manhattan’s Greenwich Village. A third man was acquitted of all charges. A jury convicted Hatem Farsakh of a high-level gang assault charge. He was tried in absentia. Sherif Rizk was convicted of a lower-level assault charge. Mahmoud Habib was acquitted on all counts. The Manhattan district attorney’s office said the defendants got into an argument, fetched a tire iron and baseball bat from Rizk’s car, and attacked a group of tourists early Jan. 13. Kevin McCarron, 24, of Andover, Mass., suffered a skull fracture.
