State identifies nursing homes cited for misleading Alzheimer's ads

State regulators Monday released the names of 51 Massachusetts nursing homes recently cited for advertising dementia care services when they don’t actually offer such care, or have not submitted paperwork to verify they are in compliance.

The list includes nursing homes from across the state, and some that are generally well-regarded for their dementia care services.

Among those cited is Life Care Center of Nashoba Valley, a Littleton nursing home that typically receives high marks from regulators.

Ellen Levinson, the facility’s executive director, said she was late submitting the paperwork, but her nursing home is otherwise in compliance.

“I applaud and understand what [regulators] are trying to do,” Levinson said. “But the takeaway message is whenever an issue is reduced to one or two lines, consumers may want to look behind the data and ask more questions.”

The state citations followed a July review by the Alzheimer’s Association of Massachusetts/New Hampshire of how nursing homes advertise their services. The review found that nearly 60 percent of facilities that advertised memory, dementia, or cognitive care had not documented the requisite programs, staffing, or design adjustments to be called a dementia special care facility.

Helen Magliozzi, director of regulatory affairs for the Massachusetts Senior Care Association, a nursing home trade group, said in an earlier interview with the Globe that nursing homes are “committed to doing the right thing and complying with the regulations and guidance provided by the [department],” but the state’s changing rules have made it difficult.

She noted that regulators completed their review of nursing home websites on Aug. 23, just two days after changing previous guidance given to nursing facilities.

“I would suspect that a significant number of nursing facilities had corrected their websites prior to the issuance of the deficiency letters” by the state health department, Magliozzi said.
