WORCESTER — An Ayer man who allegedly was driving drunk when his car struck and killed a Worcester woman and seriously injured her brother Saturday is being held without bail until a dangerousness hearing Tuesday afternoon.
In Central District Court, Daniel Depew, 29, was arraigned on charges including drunken driving (third offense), drunken driving involving a motor vehicle homicide, drunken driving involving serious injury, leaving the scene of a personal injury, and leaving the scene of property damage. He also was cited for failing to drive in the right lane, failing to slow, failing to stop, possession of an open alcohol container, and unlicensed driving.
Court documents identified the victims as Gina M. Burdick, 48, of 49 Barber Ave., and George Burdick, 46, of 128 Lincoln St. The two were helping George Burdick’s girlfriend by carrying groceries on Lincoln Street at about 7 p.m. Saturday, according to Marisell Cintron, 32, who said she was visiting her mother nearby and saw the car hit the brother and sister.
Police said Depew had two previous convictions, in Texas, for operating under the influence. An officer wrote that Depew moved to Massachusetts in May but failed to surrender his Texas license and never obtained a Massachusetts one.
Depew’s attorney, John DeVito, declined to speak to a reporter after the court proceeding Monday.
