Former Patriots receiver Malcolm Mitchell files injury grievance against the team
Former Patriots receiver Malcolm Mitchell, waived by the Patriots on Aug. 6, has filed an injury grievance against the team seeking his entire 2018 salary of $630,000, according to NFL Players Association records.
Mitchell, who had six catches for 70 yards in the Patriots’ Super Bowl LI victory over the Falcons, missed the entire 2017 season with a knee injury. This year, Mitchell did not participate in offseason workouts nor participate fully in the first two weeks of Patriots training camp, even though he was with the team. He appeared at a handful of training camp practices in his uniform, but did not participate in team drills.
Mitchell was finally released on Aug. 6, but not with an injury designation, meaning he wasn’t entitled to recoup any wages. Mitchell passed through waivers and has not signed with another team.
The Patriots are currently carrying a salary cap charge of $252,000 for the grievance. The NFL’s collective bargaining agreement states that 40 percent of an injury grievance will hit a team’s salary cap while a grievance is still pending ($252,000 is 40 percent of Mitchell’s base salary of $630,000).
A neutral physician, appointed jointly by the NFL and NFLPA, will examine Mitchell, and a neutral arbitrator will decide the case, per the CBA.
Mitchell reportedly had a procedure on his right knee on July 23, three days before the start of camp. He originally suffered a torn ACL in his knee at the beginning of the 2013 season at the University of Georgia, and missed the first four games of the 2014 season after having arthroscopic surgery on the same knee. The Patriots drafted Mitchell in the fourth round of the 2016 draft, and he played in 14 games that regular season, catching 32 passes for 401 yards and four touchdowns. A minor knee injury kept him out of the regular-season finale and first playoff game, but he returned for the AFC Championship and Super Bowl, helping the Patriots win their fifth title. Mitchell hasn’t played in a game since then.
