A commuter rail conductor, who is the son of the police chief for MBTA Transit, was convicted of manslaughter Wednesday for shooting and killing his estranged wife’s boyfriend while he slept next to her, court filings show.
Brian M. Green and his wife were in the middle of a divorce when he entered their former apartment in Everett at 4:20 a.m. on July 19, 2021 and shot Jarmahl Sutson while he was asleep, prosecutors said.
Sutson, 38, lived in Lynn and was a father of four, including Green’s estranged wife’s child.
After an 11 day trial in Middlesex Superior Court, a jury rejected a first-degree murder conviction and instead found Green guilty of manslaughter. They also convicted Green of unarmed burglary and solicitation to commit a crime, according to court records.
Green, formerly of Saugus and Providence, is being held in the Middlesex Jail. His lawyer did not respond to a request for comment from the Globe.
Green’s sentencing date was not noted in online court records.
Green’s father is MBTA Transit Police Chief Kenneth Green.
The younger Green was employed by Keolis as a commuter rail conductor at the time of his arrest. Since then, he has been suspended without pay, according to a statement from the company.
Green was 35 when he was arrested. At his arraignment hearing, prosecutors said Green had a history of domestic violence and anger toward women who tried to break up with him. They pointed to a firearms offense on Green’s record, as well as two restraining orders involving domestic violence.
Green told investigators he was not in Everett at the time of the slaying, but surveillance video and cellphone evidence placed him, his car, and his cellphone down the street from the apartment where Sutson was killed.
